A property must have enjoyed
light for a continuous period of twenty years for an easement
to have been acquired.
Right to light issues usually arise where a neighbour proposes
to extend their property. The adjoining building owner will often
object to the planning application on the basis that their level
of light will be affected by the development. However, a right
to light is not a planning consideration and so planning permission
will not be refused on this basis.
