There are two conveyancing systems in operation. One deals with titles that have been registered at the Land Registry and the other where titles have not yet been registered. If title is unregistered, then it is probable that registration will be compulsory.

  • UNREGISTERED CONVEYANCING.
    This is where title deeds and legal documents, show every time the property has been sold. Solicitors check at least 15 years previous to see that there is no unbroken chain of ownership or other title problems.
     
  • REGISTERED LAND.
    This is where the Land Registry issues a certificate confirming who owns the property at present and if there is a mortgage over it.

Once you have completed our simple questionnaire, we then begin the necessary checks to complete the conveyancing process. Our team will complete this as quickly and efficiently as possible, ensuring that you receive the best quality service possible.

When you are purchasing a property, the transaction can usually take between 6-8 weeks from the day you agree to purchase a property to exchange of Contracts, although this is only a very rough guide.

  • HOME INFORMATION PACKS

  • BEFORE EXCHANGE OF CONTRACTS
    A) Property searches are conducted. (If no Home Information Pack provided or if searches in HIP are out of date)
    B) Title is checked. (If no Home Information Pack provided or if searches in HIP are out of date)
    C) Enquiries are reviewed to provide the Buyer with various information with regard to the property.

     
  • EXCHANGE OF CONTRACTS
    This usually takes place over the telephone nowadays, but can be done in person. The date on which Contracts are exchanged is entered into the Contract together with the agreed date for completion. The signed Contract is then sent to the Seller's Solicitors together with the agreed deposit cheque. The Seller's Solicitors will also send their Clients signed copy to the Buyers Solicitors. The Contract is then legally binding and commits all parties.

Between exchange of Contracts and completion the Solicitor will carry out title searches, request mortgage funds and any other funds required by the Clients.

  • COMPLETION
    This is the day title actually transfers to the Buyer and he is entitled to possession of the property. The purchase price less any deposit already paid will be sent by telegraphic transfer to the Seller's Solicitors.

      
  • POST COMPLETION
    Even after completion the Buyers Solicitors still have work to do. They will receive the title deeds from the Sellers Solicitor and register the Buyer's and their mortgagees' interest at the Land Registry.
